Terms of Service

Welcome to Lumitone ("we," "us," or "our"), operated at lumitone.io. By accessing or using our website, services, or purchasing any product (collectively, the "Service"), you ("you" or "User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

1. Service Description

Lumitone is a cross-domain AI recommendation engine that analyzes user preferences to generate entertainment recommendations:

  • Film to Music (L2M): Analyzes a user's Letterboxd film-watching history to generate music (track) recommendations.
  • Music to Film (S2F): Analyzes a user's Spotify listening history to generate film recommendations.

Recommendations are generated by machine learning models and are provided for entertainment and discovery purposes only. We do not guarantee the accuracy, relevance, or quality of any recommendation.

2. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have obtained parental or guardian consent to use the Service.

3. Accounts and Authentication

Certain features of the Service require authentication via third-party providers (currently Spotify). When you authenticate:

  • You authorize us to access limited, read-only data from your third-party account as described in our Privacy Policy.
  • You are responsible for maintaining the security of your third-party account credentials.
  • We do not store your third-party account passwords.

4. Purchases and Payments

4.1 One-Time Payments

Lumitone offers one-time purchase packages (not subscriptions). All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's Terms of Service.

4.2 Pricing

All prices are displayed in US Dollars (USD) and are inclusive of the stated amount. Applicable taxes may vary by jurisdiction. We reserve the right to modify pricing at any time; however, any price change will not affect purchases already completed.

4.3 Digital Goods

Purchases grant you access to a specified number of AI-generated recommendations. These are digital goods delivered immediately upon purchase (or via email for guest purchases). Please review our Refund Policy for details on returns.

5. Guest (Email) Purchases

Certain packages may be purchased without creating an account. In such cases, you provide an email address and recommendations are delivered to that email. By providing an email address:

  • You confirm that the email address belongs to you or that you have authorization to use it.
  • You understand that delivery depends on a valid, accessible email address.
  • We are not responsible for non-delivery caused by incorrect email addresses, spam filters, or email provider issues.

6. Intellectual Property

6.1 Our Content

The Service, including its design, text, graphics, logos, algorithms, machine learning models, and software, is owned by Lumitone and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

6.2 Recommendation Output

Recommendations generated by the Service reference third-party content (songs, films) that is owned by their respective rights holders. Lumitone does not claim ownership over any referenced third-party content. The AI-generated recommendation lists themselves may be used by you for personal, non-commercial purposes.

7. Third-Party Services

The Service integrates with third-party platforms including but not limited to Spotify, Letterboxd, Stripe, and Supabase. Your use of these third-party services is governed by their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of any third-party service.

  • Spotify: We access your data pursuant to Spotify's Developer Terms and Privacy Policy. We request read-only access and never modify your account.
  • Letterboxd: We access publicly available profile data based on the username you provide.

8. Prohibited Uses

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to reverse-engineer, decompile, or extract source code or model weights from the Service.
  • Use automated tools (bots, scrapers) to access the Service.
  • Resell, redistribute, or commercially exploit recommendation outputs without our written consent.
  • Interfere with or disrupt the Service or its infrastructure.
  • Circumvent any access limitations, rate limits, or security measures.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Without limiting the foregoing, we do not warrant that:

  • Recommendations will be accurate, useful, or satisfactory.
  • The Service will be uninterrupted, secure, or error-free.
  • Any defects will be corrected.
  • Third-party integrations will remain available or unchanged.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LUMITONE, ITS OPERATORS, AFFILIATES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

  • Your use of or inability to use the Service.
  • Any recommendations provided by the Service.
  • Unauthorized access to or alteration of your data.
  • Any third-party conduct or content.
  • Any other matter relating to the Service.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR TEN US DOLLARS ($10.00), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Lumitone and its operators, affiliates, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Dispute Resolution

12.1 Informal Resolution

Before filing any formal legal action, you agree to first contact us at recs@lumitone.io and attempt to resolve any dispute informally for at least thirty (30) days.

12.2 Binding Arbitration

If we cannot resolve a dispute informally, any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be settled by binding arbitration in accordance with the rules of the Istanbul Arbitration Centre (ISTAC) or, if you reside in the European Economic Area, the arbitration body competent in your jurisdiction. The arbitration shall be conducted in English. Judgment on the award rendered may be entered in any court having jurisdiction thereof.

12.3 Class Action Waiver

YOU AND LUMITONE AGREE THAT ANY PROCEEDINGS TO RESOLVE DISPUTES WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than arbitration, both you and Lumitone waive any right to a jury trial.

12.4 Exceptions

Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in court for matters related to intellectual property, data security, or unauthorized access. Additionally, these arbitration provisions do not override any mandatory consumer protection rights under applicable law, including EU consumer protection regulations.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. If you are a consumer residing in the European Economic Area, you may also benefit from mandatory provisions of the law of your country of residence.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Any provisions of these Terms that by their nature should survive termination shall survive (including but not limited to Sections 6, 9, 10, 11, 12, and 13).

Purchased recommendation credits that have been delivered are not affected by account termination. Undelivered credits from paid purchases will be honored or refunded at our discretion.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify users by updating the "Last Updated" date at the top of this page and, where practicable, by posting a notice on the Service. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

16. Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision will be enforced to the maximum extent possible, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and Refund Policy, constitute the entire agreement between you and Lumitone regarding the Service and supersede any prior agreements.
